Terms and Conditions

1. Introduction
These Terms & Conditions (“Terms”) govern all services provided by Klavino (“we,” “us,” or “our”). By using our services, submitting payment, or participating in onboarding, the client (“you” or “client”) agrees to be bound by these Terms.
2. Scope of Work
Klavino provides website design, website development, automation systems, and digital marketing services tailored to plumbing and home service businesses.
Specific deliverables, pricing, timelines, and project details will be outlined in an individual proposal, invoice, or written agreement.
3. Refund & Cancellation Policy
At Klavino, we are committed to delivering high-quality work and ensuring client satisfaction. To maintain fairness and transparency, our refund and cancellation policy is as follows:
1. Website Development Services
- Design Phase Refunds: Clients may request a refund only during the design phase.
- Development Phase: Once the client approves the design and development begins, no refunds will be issued under any circumstances.
All recurring services (including hosting, automation, or marketing retainers) require a minimum of 30 days’ written notice for cancellation.
Cancellations received with less than 30 days’ notice will result in continued billing for the following cycle.
By approving the design, the client acknowledges that the project becomes non-refundable due to the time and custom work involved.
2. Marketing & System Services
SEO, automation, advertising, and lead management services are non-refundable once the service period has started.
Clients may cancel ongoing services by providing written notice at least 30 days in advance. Service will continue through the current billing cycle, and no further charges will apply after the notice period ends.
No partial refunds will be issued for unused time or paused campaigns.
3. Exceptions
We reserve the right to make rare exceptions where a refund is warranted, entirely at our discretion.
4. Cancellation Policy for Subscription Services
All recurring services (including hosting, automation, or marketing retainers) require a minimum of 30 days’ written notice for cancellation.
Cancellations received with less than 30 days’ notice will result in continued billing for the following cycle.
5. Client Responsibilities
To ensure project success, you agree to:
- Provide requested materials, access, and feedback within 7 business days
- Maintain consistent communication throughout the project
- Act in good faith and avoid unreasonable delays
If the client:
- Fails to respond or participate for 14 consecutive days, or
- Causes delays through neglect or lack of cooperation
Then any satisfaction guarantee becomes null and void, and the client remains responsible for all fees incurred.
6. Scope Changes & Additional Work
Only the work outlined in the agreed proposal is included.
Any revisions beyond the included rounds, additional pages, feature requests, or services not included in the original scope will be treated as additional work.
Additional work will be billed at $25/hour unless otherwise agreed in writing.
7. Payment Terms
By submitting payment, you automatically accept these Terms & Conditions.
- Deposits or payments are required as outlined in your invoice or proposal
- Payment schedules and milestones will be defined per agreement
- All payments are non-refundable after the refundable phase ends (see Section 3)
Late Payments
Invoices not paid by the due date may incur:
- A 1.5% monthly late fee (18% annualized) or the maximum permitted by law
- A 7-day grace period applies before late fees are charged
If payment remains unpaid for more than 30 days, Klavino reserves the right to pause all work
until balances are settled.
Accounts unpaid after 60 days may be sent to collections or pursued legally. The client is responsible for any collection or legal costs.
Outstanding balances remain due regardless of client-caused project delays.
Hosting Fees
Once the website is completed and live, a recurring hosting/support fee (as specified in your plan) will be billed monthly unless otherwise agreed.
8. Revisions
Each website project includes up to 3 rounds of revisions unless stated otherwise. Additional revisions will be billed hourly or at a flat rate, as agreed.
Revision rounds apply only prior to final design approval.
9. Termination
Upon termination:
- Refunds will only be issued according to Section 3
- The client remains responsible for all work completed to date
- Abandoned projects are non-refundable
10. Ownership and Intellectual Property
Ownership of final deliverables transfers to the client only upon full payment.
Until full payment is received, all project assets, designs, and materials remain the intellectual property of Klavino.
11. Limitation of Liability
Klavino is not liable for:
- Delays caused by client non-responsiveness
- Loss of profits, business interruption, or indirect damages
- Outcomes resulting from incomplete or inaccurate client input
- Any third-party platform changes (Google, Facebook, hosting providers, etc.)
12. Governing Law
These Terms shall be governed by and construed under applicable laws.
Any disputes will first be attempted to be resolved through good-faith mediation. If unresolved, disputes may proceed to binding arbitration.
